TRUE Off TOT’s Hook in the Dispute of Paying Excise Department…for Now
The dispute between TRUE and TOT has been decided by the Administrative Court, giving TRUE a chance to breathe.
The Administrative Court has ruled in TRUE’s favors to dismiss the arbitrator’s decision that orders TRUE to return a total amount of 1,217,505,724.17 baht to TOT. The dispute was about a decade ago that TOT gave the amount to TRUE to pay the Excise Department according to the cabinet resolution. At that time, TRUE and TOT were in a joint venture, worked to develop and expand their telecommunication businesses.
It started after the cabinet resolution was dismissed and TOT asked TRUE to return the amount that was given before, but TRUE claimed that the amount had been paid to the Excise Department. Thus, began the complaint between TRUE and TOT (among many other cases) at the court.
The arbitrator had sentenced and ordered TRUE to return the amount to TOT, but today, the Administrative Court had ruled over the arbitrator’s decision, given the reason that the arbitrator had not judged the case according to the laws and regulations.
This is one of the many cases that TRUE and TOT has been going at each other, not to mention the 76 billion baht of ADSL lawsuit that plunged TRUE’s shares 9% in a day, earlier this month.
