TPIPL Appeals the Court against the Verdict of Civil Court to Pay over ฿5bn!
TPI Polene Public Company Limited (TPIPL) has announced that on December 13, 2019 the Civil Court issued verdicts under Black Case no. sor vor 4/2559 and sor vor 6/2559 (Combining case), and sor vor 1/2560, as the Department of Primary Industries and Mines, Ministry of Industry, by the public prosecutor, as the plaintiff, filed lawsuits against TPIPL by referring to the Mineral Act and the Enhancement and Conservation of the National Environmental Quality Act, as follows:
1) Black Case no. sor vor 4/2559 and no. sor vor 6/2559 (Combining case)
Black Case no. sor vor 4/2559 : the Civil Court ordered the Company to bring industrial mineral rock for cement industry of 31,522,374.26 metric tons to fill back in the litigation area, or to pay to the plaintiff Baht 4,338,558,231.54, and interests thereon at the rate of 7.5% p.a. on the principal amount of Baht 4,047,472,854.98 from the filing date of the lawsuits case until such amount is fully paid.
Black Case no. sor vor 6/2559: the Civil Court ordered the Company to bring industrial mineral rock for cement industry of 2,447,906.76 metric tons to fill back in the litigation area, or to pay to the plaintiff Baht 327,680,219.25, and interests thereon at the rate of 7.5% p.a. on the principal amount of Baht 314,311,227.98 from the filing date of the lawsuits case until such amount is fully paid.
2) Black Case no. sor vor 1/2560: the Civil Court ordered TPIPL to bring industrial shale rock for cement industry of 1,220,559.82 metric tons to fill back in the litigation area, or to pay to the plaintiff Baht 344,882,135.15, and interests thereon at the rate of 7.5% p.a. on the principal amount of Baht 326,499,751.86 from the filing date of the lawsuits case until such amount is fully paid.
In this regard, TPIPL has asserted that the company is of the opinion that it did not commit any wrongdoing as claimed by the plaintiff, TPIPL therefore shall file the appeals against the judgments of the Civil Court to the higher Court.
As the cases are not yet final, TPILP will exercise the right to appeal and stay the enforcement of the judgments until the cases are final.
