BEM Accepts EXAT’s Proposal, Ending 17 Disputes in Exchange of a 15.8-Year Concession.
The Board of Directors of the Expressway Authority of Thailand (EXAT) has announced the resolution of the meeting yesterday regarding the negotiation with Bangkok Expressway and Metro Public Company Limited (BEM) to end the dispute totaling 58,873 million baht.
EXAT has proposed an offering of a 15.8-year extension on the concession of operating the expressway without the requirement of investing on the Double Deck. In exchange, 17 cases of dispute between the two companies worth 58,873 billion baht will be nulled.
Furthermore, the terms and conditions also allow the increase of toll fee by 10 baht every 10 years with a revenue sharing from the fee for EXAT and BEM at 60-40, while the revenue from the expressway section C will be fully booked by BEM.
The proposal has been submitted to BEM, and EXAT states that BEM has agreed to the offer.
As for the compensation worth 4,318 million baht that the Administrative Court of Thailand had made the ruling on September 21, 2018, and ordered EXAT to pay the amount to Northern Expressway Company Limited (NECL), EXAT requested that the amount must be nulled as well.
