ADVANC Rejoices! Arbitration Dismisses TOT’s Claim for ฿16bn in Roaming Service Dispute!

Advanced Info Service Public Company Limited (ADVANC) has released a statement in reference to the dispute between to ADVANC and TOT Public Company Limited (TOT) submitted to the Arbitration Institute on 27 September 2018.

Under the dispute, TOT claimed for additional revenue share from roaming service based on the 7th amendment to the main concession agreement for the period from July 2013 to September 2015 in total amount of Baht 16,252 million with a penalty interest rate of 1.25% per month.

On 11 February 2020, ADVANC received the Arbitration ruling in favor of ADVANC to dismiss TOT’s claim, with the reason that ADVANC did not breach the agreement.

However, TOT is eligible to file a petition to the Central Administrative Court to revoke the Arbitration’s ruling within 90 days after receiving the ruling. Should there be any further significant update, ADVANC will inform accordingly.
