The Central Administrative Court Dismisses TOT’s ฿5.4bn Claim on ADVANC, Appeal Awaiting!
The Central Administrative Court dismisses TOT's THB 5,454 million claim on ADVANC, opening to submit an appeal within 30 days.
Advanced Info Service Public Company Limited (ADVANC) has made an announcement today regarding the dispute that TOT Pcl. (TOT) filed a lawsuit on May 9, 2011, against CAT Telecom Plc. (CAT) and Digital Phone Co.,Ltd. (DPC), a 98.55% subsidiaries of ADVANC, to jointly pay the access charge under the Interconnection Agreement in the total amount of THB 5,454 million plus interest as details provided in Form 56-1 part 1 page 51.
Today, the Central Administrative Court revokes the dispute case with the consideration that TOT’s claim does not conform to the notification of the National Telecommunication Commission on the Telecommunication Network Access and Interconnection. DPC, therefore, shall not be liable to pay the access charge as claimed. However, TOT can file a petition to the Supreme Administrative Court within 30 days from the date of judgement of the Central Administrative Court.
